- In Germany, the separation between judges and civil servants is incomplete. The statutes on the legal status of judges often refer to the rules for civil servants, e. g., concerning the official duties, the disciplinary procedure or the remuneration. The final decision on the selection and promotion of judges is taken by ministers on the Länder or the federal level. In half of the Länder an electoral committee for judges participates in the decision but fewer than half of the members are elected representatives of the judges. This is justified by the constitutional doctrine of democratic legitimation, which requires that judges as well as civil servants are selected by ministers responsible to parliament. This doctrine is not compatible with the necessity to guarantee judicial independence required by Art. 6 ECHR, Art. 19 TEU and the principle of the separation of powers.
