- This article is dedicated to the controversial question of the extent to which the federal and state administrations can and may currently use gender-inclusive language via binary symbols within words (e. g. gender-star, gender-gap or the double colon). To clarify this question, the constitutional requirements of “language” must be exam?i?n?e?d first. Based on this, the current legal situation for the state authorities and – w?h?e?r?e possible – the federal authorities will be analyzed in detail. The ordinary legal situation on language regulations of the federal and state administrations is then examined to a constitutional review. On the one hand, the compatibility of the legal framework with the fundamental rights to freedom and equality is examined. On the ot?h?e?r hand, it also depends on whether and to what extent ordinary law can set requirements for municipalities that find themselves in a special legal situation by reason of the right to self-determination granted to them by Article 28 (2) of German Constitution.
