the municipal authorities passed a resolution tending . to remedy this defect, as far as the Act of July 2.,, 1875 may not be applicable. That resolution concerns cases in which public money is spent on making such alterations or improvements ( Veran- staltungen) with regard to streets and squares as serve to increase the value of certain premises, so that particular economical advantages accrue to their owners. Thus the widening of a street increases the value of the adjacent premises by affording a possibility of erecting higher buildings on them than before, because, according to § 3, No. 1a of the building- regulation issued by the Board of Works (Baupolizeiordnung), the height of buildings in streets within the township of Berlin must not exceed the width of the street between the alinements. Also the creation of a new communication by building a bridge will contribute to increasing the value of the neighbouring premises. In consequence of such particular economical advantages the owners of premises are liable to contributions towards the costs of the alterations or improve- ments. The said resolution runs as follows: ‘Towards the expense for widening streets, laying out squares, and, inasmuch as new ways of communication are created thereby, also for constructing bridges, subways, and viaducts (Strasseniiberfiihrungen) inclusive of the requisite slopes and approaches, those landlords who derive particular economical benefits from such alterations or improvements, shall have to pay contributions corresponding to the amount of benefit derived.’ That resolution has not hitherto had any tangible result. However, after the adoption of a new ground-tax according to ‘common value’ has been resolved upon, it is not altogether impossible, that the above resolution of the municipal authorities may be revised, and that instead of a 5}
