E s i s t a l s o d u r c h a u s die M ö g l i c h k e i t g e g e b e n , meine D a m e n und H e r r e n , daß in B e r l i n an p r i v a t e E i g e n t ü m e r in f r ü h e r e n J a h r e n und J a h r z e h n t e n B e r g w e r k s e i g e n t u m auf B r a u n k o h l e n v e r l i e h e n w o r den i s t , und d i e s e r B e r g w e r k s e i g e n t ü r n e r h ä t t e d u r c h a u s die j u r i s t i s c h e Möglichkeit, einem etwaigen B e r g b a u v e r s u c h , der n e u e r l i c h hier eingeleit e t w o r d e n i s t , S c h w i e r i g k e i t e n r e c h t l i c h e r N a t u r in d e n Weg zu l e g e n . F e r n e r w ü r d e e s n a c h d e m B e r g g e s e t z notwendig s e i n , d a ß d i e Stadt B e r l i n , wenn s i e B e r g b a u t r e i b e n w o l l t e , s i c h d a s B e r g w e r k s e i g e n t u m auf die B r a u n k o h l e n oder auf ein a n d e r e s M i n e r a l z u n ä c h s t v e r l e i h e n l i e ß e von d e r B e r g b e h ö r d e . E i n e s o l c h e B e r g b e h ö r d e für B e r l i n b e s t e h t a b e r n i c h t m e h r , da wir ja n i c h t m e h r d e m O b e r b e r g a m t H a l l e a n g e s c h l o s s e n sind und a n g e s c h l o s s e n s e i n k ö n n e n . Wir w ü r d e n a l s o i r g e n d e i n e R e c h t s k o n s t r u k t i o n finden m ü s s e n , da w i r u n s d a s B e r g w e r k s e i g e n t u m e r s t v e r leihen l a s s e n wollten. E n d l i c h s t e h t d i e s e f r ü h e r e R e g e l u n g d e s B e r g g e s e t z e s von 1865 m i t u n s e r e n h e u t i g e n A n s c h a u u n g e n n i c h t m e h r i m E i n k l a n g . H e u t e sind w i r ü b e r z e u g t - und ich g l a u b e , da sind w i r u n s a l l e in d i e s e m H a u s e e i n i g - , d a ß die B o d e n s c h ä t z e d e r A l l g e m e i n h e i t g e h ö r e n , und d a ß d i e A l l g e m e i n h e i t n a c h G e s i c h t s p u n k t e n d e s öffentlichen Wohls ü b e r d i e s e B o d e n s c h ä t z e zu e n t s c h e i d e n h a t .
